Welcome to GoApply! These Terms of Service ("Terms") govern your access to and use of our AI-powered job application platform, website, and services (collectively, the "Service"). By accessing or using GoApply, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree to these Terms, you may not access or use the Service.

1. Agreement to Terms

By creating an account, accessing, or using GoApply, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you are under 18, you may not use GoApply. We do not knowingly collect information from or direct our Service to individuals under 18.

To use GoApply, you must create an account using Google OAuth authentication. You agree to:

• ✗Create an account using false or misleading information

5.1 Your Content

You retain ownership of all content you upload, including resumes, cover letters, work history, and other personal information ("User Content"). However, to provide the Service, you grant us a limited license.

5.2 License Grant

By uploading User Content, you grant GoApply a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to:

• •Host, store, reproduce, and process your User Content
• •Modify and adapt User Content to create tailored resumes and cover letters
• •Submit User Content to employers on your behalf
• •Use User Content to improve our AI models and Service (anonymized)

This license exists solely to operate and improve the Service. We will not sell your User Content or use it for purposes unrelated to providing the Service.

5.3 Content Accuracy

You represent and warrant that all User Content you provide is accurate, complete, and does not infringe on any third-party rights. You are responsible for the accuracy of your resume, work history, and other information submitted to employers.

7. AI and Automated Decision-Making

GoApply uses artificial intelligence (AI) and machine learning models to:

While we strive for accuracy, AI-generated content may contain errors. You are responsible for reviewing all materials before submission.

8. Payment and Subscription Terms

8.1 Pricing

GoApply offers both free and paid subscription plans. Pricing is displayed on our website and is subject to change with 30 days' notice to existing subscribers.

8.2 Billing

• •Subscriptions are billed in advance on a monthly or annual basis
• •Payment is due immediately upon subscription or renewal
• •All fees are non-refundable except as required by law
• •You authorize us to charge your payment method automatically

8.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

Refund Policy: We offer a 7-day money-back guarantee for first-time subscribers. After 7 days, all fees are non-refundable. No refunds for partial months or unused features.

8.4 Price Changes

We may change our pricing at any time. For existing subscribers, price changes will take effect at your next renewal after 30 days' notice. Continued use after price changes constitutes acceptance.

The Service, including all content, features, functionality, software, code, design, graphics, and trademarks, is owned by GoApply and protected by copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal job search purposes only. This license does not include any right to:

• ✗Reverse engineer or decompile any part of the Service
• ✗Resell, lease, or sublicense the Service

"GoApply" and our logo are trademarks of GoApply. You may not use our trademarks without our prior written permission.

10. Third-Party Services and Links

The Service integrates with third-party platforms including:

• •Job boards (LinkedIn, Indeed, Workday, Greenhouse, Lever, etc.)
• •Company Applicant Tracking Systems (ATS)
• •Google OAuth for authentication

These third-party services have their own terms and privacy policies. We are not responsible for their content, features, or practices. When you submit applications through our Service, you also agree to comply with those platforms' terms.

11. Disclaimers and Limitations

11.1 "AS IS" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• •Accuracy, completeness, or reliability of content
• •Uninterrupted, timely, secure, or error-free operation
• •Results obtained from using the Service

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOAPPLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF EMPLOYMENT OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

You agree to indemnify, defend, and hold harmless GoApply and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to:

13. Termination

13.1 Your Right to Terminate

You may terminate your account at any time through your account settings or by contacting support. Upon termination, your access to the Service will end immediately.

We may suspend or terminate your account at any time, with or without notice, for:

• •Fraudulent, abusive, or illegal activity
• •Non-payment of fees
• •Extended inactivity
• •Any reason at our sole discretion

13.3 Effect of Termination

Upon termination, you will lose access to your account and all data. We will delete your personal information in accordance with our Privacy Policy, except as required for legal compliance. No refunds will be provided for prepaid subscription fees.

If you have a dispute with GoApply, please contact us at admin@goapply.ai to attempt informal resolution before pursuing formal action.

14.2 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

14.3 Arbitration Agreement

Any dispute arising out of or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court, except that you may assert claims in small claims court if they qualify. You waive your right to a jury trial.

14.4 Class Action Waiver

You agree that disputes will be resolved individually, not as a class action, class arbitration, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
